Abstract

Marriage dispensation allows children under 19 to marry with court permission, and Supreme Court Regulation (PERMA) No. 5 of 2019 requires judges to identify the child’s psychological condition and readiness. How “mental readiness” is understood and assessed in practice, however, has received little attention. This study examines how institutional stakeholders in Tasikmalaya City understand and assess children’s mental readiness in dispensation cases, and reads their accounts through Erikson’s psychosocial theory and the fiqh concept of rushd. This exploratory qualitative study involved three purposively selected informants: a registry clerk for voluntary petitions at the Religious Court, the head of a sub-district Office of Religious Affairs (KUA), and a religious leader who formerly headed a KUA. Data were collected through semi-structured interviews and observation in June–July 2026 and analysed thematically. The analysis produced four themes: (1) mental readiness is understood as multidimensional and not identical with age; (2) the informants’ emphasis on “mature thinking” can be read as identity consolidation, although it was not expressed in psychological terms; (3) readiness assessment is largely impressionistic and did not draw on the professional recommendations provided for in PERMA; and (4) the principles of rushd and maṣlaḥa are acknowledged but not operationalised. The main gap lies in implementation rather than in the absence of norms. Further research should involve judges, children, and parents.
